Title

1. This notice may be cited as Moreton Bay Regional Council (Making of Local Law) Website Notice (No. 1) 2018.

Making of local law

2. Moreton Bay Regional Council (the “Council”) has, by resolution dated the 27th day of March 2018, made

(a) Moreton Bay Regional Council Local Law No. 7 (Waste Management) 2018 (the “local law”); and

(b) Moreton Bay Regional Council Community and Environmental Management (Amendment) Subordinate Local Law (No. 1) 2018 (the “subordinate local law law).

Purpose and general effect

3. The purpose and general effect of the local law is to protect the public health, safety and amenity related to waste management by

(a) regulating the storage, servicing and removal of waste; and
(b) regulating the disposal of waste at waste facilities; and
(c) ensuring that an act or omission does not result in
(i) harm to human health or safety or personal injury; or
(ii) property damage or loss of amenity; or
(iii) environmental harm or environmental nuisance.

4. The purpose and general effect of the subordinate local law is to omit various provisions from Moreton Bay Regional Council Subordinate Local Law No. 3 (Community and Environmental Management) 2011 which are replaced by provisions in Moreton Bay Regional Council Local Law No. 7 (Waste Management) 2018.

Authorising local law

5. Moreton Bay Regional Council Local Law No. 3 (Community and Environmental Management) 2011 authorises the making of Moreton Bay Regional Council Community and Environmental Management (Amendment) Subordinate Local Law (No. 1) 2018.

Subordinate local law amended

6. Moreton Bay Regional Council Community and Environmental Management (Amendment) Subordinate Local Law (No. 1) 2018 amends Moreton Bay Regional Council Subordinate Local Law No. 3 (Community and Environmental Management) 2011.

Anti-competitive provision

7. The local law contains anti-competitive provisions.

Inspection

8.Copies of the local law and the subordinate local law may be

(a) inspected and purchased at Council’s public office and viewed by the public on the website of Council; and
(b) viewed by the public on the website of the Department of Local Government.
