MBRC eServices Website Terms of Service

This website is owned and operated by Moreton Bay Regional Council (ABN: 92 967 232 136). By accessing and/or using this website and related services, you agree to these Terms and Conditions, which include our Privacy Statement  (Terms). You should review our Privacy Statement and these Terms carefully and immediately cease using our website if you do not agree to these Terms.

In these Terms, 'us', 'we' and 'our' means Moreton Bay Regional Council (ABN: 92 967 232 136).

2.3 Our Privacy Statement and Information Privacy Plan explains: (i) how we store and use, and how you may access and correct your personal information; (ii) how you can lodge a complaint regarding the handling of your personal information; and (iii) how we will handle any complaint. 3. Accuracy, completeness and timeliness of information

and we may plead this release as a complete defence to any proceedings connected with these matters.

9.2 You indemnify us and our employees, councillors, agents and contractors (Those Indemnified) against any direct or indirect loss, damage, claim or expense made against, or suffered or incurred by, Those Indemnified, which arises from or is any way connected with:

(c) your breach of these Terms.

9.3 The indemnity in clause 9.2 is a continuing obligation and survives termination, completion or expiration of these Terms.  It will not be necessary for us to incur any expense or to make any payment before enforcing a right of indemnity conferred by clause 9.2 and you must pay on demand any amount that you must pay under an indemnity in clause 9.2.

10. General

10.1 These Terms may not be modified, amended or otherwise varied except by a document containing our signed consent to the modification, amendment or variation.

10.2 Any provision of these Terms which is held to be illegal, void or unenforceable is only ineffective to the extent of that illegality, voidness or unenforceability, without invalidating the remaining provisions of these Terms.

10.3 These Terms are not to be construed adversely to a party just because that party prepared them or caused them to be prepared.

10.4 Your use of the website and these Terms are governed by the law of Queensland and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Queensland.
