Planning Scheme Amendments

The Moreton Bay Regional Council Planning Scheme 2016 has had a number of amendments since it commenced on 1 February 2016 and continues to be amended in response to the changing needs of our region. Major Amendment No. 4 - Morayfield South Emerging Community Area and Designated Bushfire Prone Areas

On 13 December 2023, Council resolved to make a major amendment to the Moreton Bay Regional Council Planning Scheme 2016 called 'Major Amendment No.4 Morayfield South Emerging Community Area and Designated Bushfire Prone Areas' and send it to the Planning Minister for State interest review. 

The amendment proposes to incorporate the updated Morayfield South Structure Plan into the Planning Scheme. This follows a period of early consultation where we asked for feedback on the draft structure plan. 

In addition, the proposed amendment will address a gap relating to the Planning Scheme's 'Designated Bushfire Prone Areas' and the requirements for building work in these areas. The proposed amendment does this by removing certain exclusions that currently exist, which mean specific areas across the city are not part of the designated 'Bushfire Prone Area'. 

The proposed change will ensure particular types of new buildings in all areas mapped as 'Bushfire Prone Areas' need to comply with requirements for building works to improve bushfire resilience and public safety.

Next steps

The State Government is currently reviewing the proposed amendment. 

Once this review is complete, the community will have the opportunity to provide feedback on the amendment during a statutory public consultation period. It is anticipated this will occur in mid to late 2024.

Major Amendment No. 3 - Better Housing Amendment

On 2 August 2023, Council resolved to make available for public comment the MBRC Scheme 2016 Better Housing Amendment - Major Amendment No. 3.

Between 7 August and 4 September 2023, Council asked the community to provide their feedback. This consultation has now closed. We would like to thank all those who shared their views with Council. A Consultation report has been prepared by Council to outline what we heard and how the matters raised in submissions have been addressed.

The purpose and general effect of the proposed amendment is to support policy changes relating to:

  • the Next generation neighbourhood precinct (and the equivalent Transition precinct and parts of the Caboolture West local plan) including requirements for more greenspace and larger yards and more liveable, comfortable and attractive development
  • how secondary dwellings are designed and located
  • off-street car parking ratios to more appropriately cater for resident and visitor parking demand for: Multiple dwellings, Student accommodation, Dual occupancy and Dwelling houses
  • the design of Student accommodation development
  • a reduction to the boundary of the Warner Investigation Area to re-clarify Council’s position on future urban growth and development in the area.

Next steps

Council will now give notice to the Planning Minister requesting approval to adopt the Better Housing Amendment (including the changes made in response to submissions).

The Minister typically has 40 business days from the date of receiving Council’s notice to make this decision and advise Council. 

Proposed changes to the Planning Scheme will take effect subject to the receipt of the Minister’s decision (and conditions - if any) and Council subsequently making a decision to adopt and commence the amendment.

Amendment No. 2 - Planning Scheme Policies

Status

On 2 August 2023, Council resolved to amend the following Planning Scheme Policies (PSPs) that support the MBRC Planning Scheme 2016:

(a) PSP - Neighbourhood Design
(b) PSP - Residential Design
(c) PSP - Integrated Design (Appendix A - Streets, Roads and Utilities and Appendix D - Landscape design and Street trees)
(d) PSP - Township Character.

Between 7 August and 4 September 2023, we asked the community to provide feedback on the draft Planning Scheme Policies Amendment No. 2 (PSPs amendment), which is proposed in support of the Better Housing Amendment - Major Amendment No. 3.

This consultation has now closed. We would like to thank all those who have shared their view with Council.

The outcome of the PSPs amendment is dependent on the finalisation of the Better Housing Amendment - Major Amendment No. 3 and will be the subject of a future separate Council report, timed to align with Council’s formal decision regarding adoption of the proposed amendment. Submitters to the PSPs amendment will be notified in due course, subject to the above.

PSPs support the operation of the Planning Scheme by providing guidance, standards and specifications referenced by the scheme.

PSPs Neighbourhood Design, Residential Design and Integrated Design are targeted for amendment, providing updated guidance, and standards and specifications for consistency with the changes proposed in the Better Housing Amendment.

Changes to the PSP Township Character are also proposed to better reflect and support the unique township character of D’Aguilar, Dayboro, Samford Village, Wamuran and Woodford.

On 8 December 2021, Council resolved to adopt the Local Government Infrastructure Plan (LGIP) Interim Amendment No. 1. The amendment commenced on 21 December 2021.

These documents are not part of the Planning Scheme but are essential in understanding how the LGIP has been prepared.

On 26 May 2021, Council agreed to make an amendment to the Moreton Bay Regional Council Planning Scheme for the LGIP Interim Amendment No.1 under Section 21(c) of the Planning Act 2016. The amendment has followed the process set out in Chapter 5, Part 2 of the Minister’s Guidelines and Rules (September 2020).

Caboolture West Local Plan Neighbourhood Development Plan Area No.1 (NDP1) (Effective from 26 October 2021)

Status

On 18 August 2021, Council resolved to adopt an amendment to the MBRC Planning Scheme for Neighbourhood Development Plan No.1 (NDP1) of the Caboolture West local plan. The amendment commenced on 26 October 2021.

This amendment is supported by and coincides with a new Planning Scheme Policy - Caboolture West Local Plan - Neighbourhood Development Plan No.1 (NDP1), which was adopted by Council on 20 October 2021 and commenced concurrently on 26 October 2021.

On 9 December 2020, Council agreed to initiate an amendment to the MBRC Planning Scheme under Section 18 of the Planning Act 2016 for NDP1 of the Caboolture West local plan.

The amendment followed a tailored amendment process, as agreed to by the Department of State Development, Manufacturing, Infrastructure and Planning (the Department). Planning Scheme Policy - Caboolture West Local Plan - Neighbourhood Development Plan No.1 (NDP1) (Effective from 26 October 2021)

Status

On 20 October 2021, Council resolved to adopt a new Planning Scheme Policy - Caboolture West Local Plan - Neighbourhood Development Plan No.1 (NDP1) (the PSP) to be included in the MBRC Planning Scheme. The PSP commenced on 26 October 2021. 

The purpose of the PSP is to provide an overview of the land use and infrastructure planning rationale in preparing Neighbourhood Development Plan No.1 (NDP1).

The PSP supports the “Caboolture West Local Plan Neighbourhood Development Plan Area No.1 (NDP1)” amendment (the NDP1 amendment), with both commencing concurrently.

On 31 March 2021, Council resolved to create a new Planning scheme policy that supports the NDP1 amendment by providing an overview of the land use and infrastructure planning rationale for NDP1. The PSP preparation followed the process found in the Minister’s Guidelines and Rules and did not follow a tailored amendment process.

On 12 December 2019, Council resolved to adopt “Tailored Amendment No.1” to the Moreton Bay Regional Council Planning Scheme and set a commencement date of 29 January 2020.

Note that this amendment coincided with “Planning Scheme Policies Major Amendment No.1”.

Process

The term ‘Tailored’ refers to the process the amendment is required to follow under the Planning Act 2016.  As the name suggests it is not a standard process as outlined in the Minister’s Guidelines and Rules. Rather it is a process specific to this amendment that has been agreed to by the Department of State Development, Manufacturing, Infrastructure and Planning (the Department). Alignment Amendment 1 (Effective from 3 July 2017)

On 27 June 2017, Council adopted an alignment amendment to the MBRC Planning Scheme. The adopted amendment has effect on, and from, 3 July 2017.

The purpose and general effect of the amendment is to:

  • reflect terminology used in the Planning Act 2016, the Planning Regulation 2017 and related State planning instruments, as well as to improve the clarity and operation of the MBRC planning scheme.

Local Government Infrastructure Plan Amendment No. 1 (Effective from 3 July 2017)

Amendment 1 (Effective from 3 July 2017)

On 20 June 2017, Council adopted an amendment to the MBRC Planning Scheme to include a Local Government Infrastructure Plan (LGIP) and make an LGIP related administrative amendment to the MBRC Planning Scheme. The adopted amendment has effect on, and from, 3 July 2017.  The purpose and general effect of the amendment is to:

  • include a Local Government Infrastructure Plan within the MBRC Planning Scheme.

Administrative and Minor Amendment No. 2 (LGIP related) (Effective from 3 July 2017)

Amendment 2 (Effective from 3 July 2017)

On 20 June 2017, Council adopted an administrative to the MBRC Planning Scheme. The adopted amendment has effect on, and from, 3 July 2017.

The purpose and general effect of the amendment is to:

  • replace all references to a Priority Infrastructure Plan and PIP with Local Government Infrastructure Plan and LGIP respectively.

Administrative and Minor Amendment No. 1 (Effective from 20 June 2016)

Amendment 1 (Effective from 20 June 2016)

On 14 June 2016, Council adopted an administrative and minor amendment to the MBRC Planning Scheme. The adopted amendment has effect on, and from, 20 June 2016.

The purpose and general effect of the amendment is to:

  • correct spelling, grammar, numbering and formatting errors
  • remove out of date text
  • reflect current QPP mandatory wording
  • align terminology used in different parts of the document and correct inconsistencies
  • amend, add and delete Editor's notes and other explanatory text as necessary to assist in navigating and interpreting the document
  • remove unnecessary duplication
  • correct references to figures
  • correct factual matters that are incorrectly stated in the planning scheme
  • align zone extents and overlay details with the property boundaries and road alignments shown on the current digital cadastral data base (DCDB) supplied by the State
  • amend explanatory notes on maps as necessary to improve their usability
  • adjust some zones and overlay maps to reflect current development approvals
  • more effectively identify the extent of some overlay features referred to in planning scheme codes
  • align various overlay maps with current constraint data published and supplied by the State
